NOTICE OF VIOLATION Carolina Power
& Light Company Shearon Harris Unit
,Docket No. 50-400 License No.
NPF-63 During an NRC inspection conducted on September 3 - October 7, 1995, violations of NRC requirements were identified.
In accordance with the
"General Statement of Policy and Procedure for NRC Enforcement Actions," 60 FR 34381, June 30, 1995, the violations are listed below:

Technical Specification 6.8. I.a requires procedures recommended in Appendix A of Regulatory Guide 1.33, Rev.
2, February 1978, "guality Assurance Program Requirements (Operation),"
be established, implemented, and maintained.
Regulatory Guide 1.33, Appendix A, Section 1.c includes administrative procedures for equipment control.
This requirement was partially implemented by procedures OMM-014, Rev.
4, Operation of the Work Control Center.;
and OMM-007, Rev.
4, Operations Surveillance, Periodic and Reliability Tests.
Procedure OMM-014, required that the Senior Control Operator annotate all applicable Equipment Inoperable Records when equipment failed surveillance testing or portions of the test were not completed.
The procedure further required that the SCO accomplish this by entering all pertinent information in the Remarks section of the Equipment Inoperable Records.
Procedure OMH-007 required that the Shift Supervisor ensure than an EIR was completed when an Operations Surveillance Test failed to meet acceptance criteria.
Contrary to the above, on August 2, 1995, control room personnel failed to follow procedures OHM-007 and OMM-014 by not documenting on equipment inoperable records that the
"B" charging/safety injection pump minimum flow check valve had failed a forward flow test.
This resulted in the
"B" charging/safety injection pump being placed in service on September 2,
1995, without properly being tested.
This is a Severity Level IV violation (Supplement I).
CFR 50, Appendix B, Criterion V, Instructions, Procedures, and Drawings, requires, in part, that activities affecting quality shall be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances, The licensee's Corporate guality Assurance Program Manual, which implements the regulatory requirement, states in paragraph 6.3.6 that provisions shall be made for the review of procedures required by plant commitment by an individual knowledgeable in the area affected to determine the need for changes.
The licensee's corporate manual parenthetically mentions those procedures described in Regulatory Guide 1.33.
Regulatory Guide 1.33, Appendix A, section B.b.(1)(r) includes procedures for auxiliary feedwater system surveillance tests.

Contrary to the above, the licensee failed to provide for the review of a temporary procedure testing auxiliary feedwater system valves'esponse to a safety injection signal by personnel fully knowledgeable in the system's logic.
This resulted in an inadequate procedure which led to an unplanned partial safety injection, This is a Severity Level IV violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the U. S.
Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response.
If an adequate reply is not received within the time specified in this Notice, an order or Demand for Information.may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
However, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis to support your request for withholding the information from the public.
