NRC INSPECTION REPORT NO. 50-400/94-13 This will acknowledge receipt of your response of August 24, 1994, to our Notice of Violation issued on July 25, 1994, concerning activities conducted at your Harris facility.
We have examined your response and found that it meets the requirements of
CFR '2.201.
In your response, you denied violation A and admitted violation B.
With respect to violation A, we understand your explanation of the sequence of events to use priority-E work to open valve 1SW-20 and concur that a violation of Technical Specification (TS) 6.8. l.a did not occur.
The decision by the nuclear shift supervisor to authorize emergency work was based upon a
perceived impression that TS 3.0.3 was applicable and that immediate work was required to avoid an unnecessary plant transient.
Only after a detailed review of the system design was it subsequently determined that TS 3.0.3 was not applicable.
Therefore, we conclude that the shift supervisor's actions were appropriate.
As a result of the telephone conversation with Hr. Prunty of your staff on September 6,
1994, we understand that you will provide additional guidance to the shift supervisors to help them in similar situations with TS 3.0.3 applicability.
Accordingly, we will adjust our records to reflect that no violation of regulatory requirements occurred with respect to Item A.
We will examine the implementation of your action to correct violation B
during future inspections.
