SUBJECT: MCGUIRE NUCLEAR STATION - NRC TEMPORARY INSTRUCTION 2515/186 INSPECTION REPORT 05000369/2013406 AND 05000370/2013406

Dear Mr. Capps:

On November 21, 2013, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at your McGuire Nuclear Station, Units 1 and 2, using Temporary Instruction (TI) 2515/186, "Inspection of Procedures and Processes for Responding to Potential Aircraft Threats." On November 21, 2013, the NRC inspectors discussed the results of this inspection with Mr. Chuck Morris and other members of your staff. The inspectors documented the results of this inspection, as well as the resolutions to four previously identified Cyber Security issues, in the enclosed inspection report. The objective of this inspection was to assess the implementation procedures and processes of McGuire Nuclear Station that are required by Title 10 of the Code of Federal Regulations (10 CFR), Part 50.54(hh)(1), which provides the requirements for responding to a potential aircraft threat. The results from this inspection, along with the results from this inspection performed at other operating commercial nuclear plants in the United States, will be used to evaluate the U.S. nuclear industry's readiness to safely respond to similar events. These results will also help the NRC to determine if additional regulatory actions are warranted. The NRC inspectors did not identify any findings or violations of more than minor significance.

In accordance with 10 CFR 2.390, "Public inspections, exemptions, requests for withholding," of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC's Public Document Room, or from the Publicly Available Records (PARS) component of the NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1), and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the Enclosure will not be made available electronically for public inspection in the NRC Public Document Room, or from the PARS component of NRC's ADAMS. If you choose to provide a response and Security-Related Information is necessary to provide an acceptable response, please mark your entire response "Security-Related Information - Withhold from public disclosure under 10 CFR 2.390," in accordance with 10 CFR 2.390(d)(1), and follow the instructions for withholding in 10 CFR 2.390 (b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response contained in the Enclosure, and in accordance with 10 CFR 2.390, a copy of this letter's Enclosure will not be available for public inspection.
