SUBJECT: NRC INSPECTION REPORT NOS. 50-327/93-11 AND 50-328/93-11 Thank you for your response of May 24, 1993, to our Notice of Violation issued on April 3, 1993, concerning activities conducted at your Sequoyah facility.

After careful consideration of the bases for your denial of the violation, we have reached the following conclusions:

1)

Upon discovery of the Intermediate Range Monitor's trip.setpoint being above allowable limits, your staff took the appropriate corrective actions for the inoperable instrument.

2)'

Setpoint drift and calculational error contributed to the out of tolerance condition of the instrument.

Because the drift could have occurred after reactor mode changes were made, we do not believe the

,'

event was reportable.

Therefore, we have concluded that there is no substantive evidence of a

'

violation and the violation will be withdrawn.

However, you also claimed the Technical Specification allowable value was not exceeded because the difference between the nominal trip setpoint and the allowable value is only based on rack error terms. We disagree with this evaluation. After further discussions with your staff, we have agreed that if the setpoint of an instrument is not found to be within Technical Specifica-tion tolerance for any reason that it will be declared inoperable and the appropriate action statements followed.
