SUBJECT: NRC Inspection Report 050000285/2006015, Reply to a Notice of Violation Reference 3 transmitted a Notice of Violation (NOV) to the Omaha Public Power District (OPPD). The NOV resulted from a failure to conduct an adequate analysis of the effects of the waterborne threat at the Fort Calhoun Station.Attached is the OPPD response to this NOV.The violation noted in Reference 3 occurred prior to the time that the NRC issued Regulatory Issue Summary 2006-13, "Information on The Changes Made to the Reactor Oversight Process to More Fully Address Safety Culture." Reference 3 was prepared and dated following issuance of RIS 2006-13. As a result, at the time this letter was prepared, the safety culture aspects of this issue have not been addressed in the Root Cause Analysis (RCA) or in the Corrective Action Program (CAP). This analysis is currently being addressed and will be completed commensurate with completion of work associated with regaining compliance.

Upon completion of the analysis, the safety culture aspects will be addressed in either an amendment to the RCA or in the associated CAP condition report.Attachments I and 2 Contain Safeguards Materia Decontrolled When Separated From Attachment 1 and 2.SAFEGUARDS INFORMATION e I;Employment with Equal Opportunity fit 4171 U.
