NOTICE OF VIOLATION (NRC INSPECTION REPORT 50-255/97015(DRS))
Dear Mr. Palmisano:
This will acknowledge receipt of your letter dated January 20, 1998, in response to our letter dated December 13, 1997, transmitting a Notice of Violation (NOV) associated with the failure to post a high radiation area, the failure of staff to be aware of dose rate levels prior to entry into a high radiation area, and the failure to conduct radiological surveys in accordance with plant procedures. Your response to the NOV agreed with the three violations, but you identified apparent discrepancies regarding two statements relating to particular event times and descriptions for two of the violations. The following discussion. regarding the NOV response is based on our review of your response and a telephone conversation with members of your health physics s~aff on February 2, 1998.
Regarding the first violation, for failure to post a high radiation area, you state that the lack of required posting may have occurred as early as 9:41 a.m. on September 15, 1997, while the NOV states that the lack of high radiation area posting began at approximately 11 :30 a.m. on September 15, 1997. Although we understand your position, the NOV was based on statements made to the inspectors by plant personnel who conducted work activities in the Clean Waste Filter Room on the morning of September 15, 1997. Therefore, based upon those statements we concluded that at approximately 11 :30 a.m. the high radiation area was unpasted.
Regarding the third violation, for failure to perform contamination surveys, you state that the NOV should read "On September 10, 1997... " rather than, "On September 8 and 10, 1997... ".
Based on our further review of radiological survey sheets and the conversation with your staff, we agree that the NOV should refer only to the failure to perform a contamination survey on September 10, 1997. The corrected page is enclosed 9802170093 980205 PDR ADOCK 05000255 G
