In response to your inquiry, the following

.h Dr. Gallina conducted an inspection of the Oyster Creek Nuclear Station

,

on October 1, 1973 (R0 Inspection Report No.. 50-219/73-16).

Since the date of the previous inspection is.also listed on the report cover sheet (September 10-12,'1973), the September date may have been misinterpreted as the actual data of the inspection. The date of previous inspection refers to the date for the inspection conducted at the site having the report utenber sequentially preceding 50-219/73-16 and not to the previous inspection conducted by Dr. Gallina.

M The Summaary of Findings of the aforementioned report (50-219/73-16) lists thirteen violations identified during an _ earlier inspection (50-219/73-03)

which was conducted by Dr. Gallina in February and March of 1973. The Stannary goes on to state that these violations were reviewed by Dr. Gallina and all were found to have been fully corrected.

These reports may be referred to for details.

It should be noted further, however, that each of the thirteen violations identified related to the failure on the part of the licensee to take required environmental samples and not to releases of radioactivity to the air and tmter in excess of any AEC requirements.

Problem:

Fish Mortalities are Predicted to Occur When Reactor Makes,

a Scheduled Shutdewn on February 5, 1975

.

The licensee reported to Region I (King of Prussia, Pennsylvania). by telephone on February 3,1975, that there was a high probability that

'

a fish kill would occur when the reactor was shut down to perform the i

!

safety related piping inspections as required by IE Bulletin 75-01 is-sued on January 30, 1975.

'

The following preliminary information was supplied by the licensee:

1.

The facility will be shutdown on February 5,1975, beginning about

'

9:00 p.m., to complete inspection requirements pursuant to IE Bulletin 75-01.

2.

A sizeable fis'.) population (mostly menhaden) is presently situated in the plant's effluent canal.

3.

Existing water temperatures in the plant's effluent canal and Barnegat Bay (the source of supply water for the station) are

>

55 degrees F and 34 degrees F, respectively.

4.

The lethal minimum temperature for menhaden, blue, and spot fish

-

is approximately 37 degrees F.

,

5.

When the station shutdown occurs, the v. ster temperature in the effluent canal is expected to cool down to the supply water tem-

perature of 34 degrees F.

6.

Based on preliminary ectimates, a fish kill is predictable with

visual fish mortalities appearing February 6, 1975, following the

,

temperature equalization of the effluent canal water with the bay water.

Action 1.

The licensee and his. environmental group (JCP&L) will be onsits and will monitor the fish kill.

2.

The licensee will use available (limited) options to mitigate poten-

tial consequences, including cessation of dilution water and circu-J 1ating water flow during the shutdown and will reduce temperatures as' slowly as practicable.

3.

The l'icensee h'as issued a press release.

4.

The licensee will' file a report to the Commission when and if the event takes place.

,

5.

IE representatives and a consultant (Fishery Biologist) will be onsite.

Further action by IE will be based on developments (e.g., *

Press Release).

6.

The State of New Jersey has been notified by IE.
