The enforcement options pertaining to the apparent violation were also discussed with the licensee.
The licensee summarized the event, their evaluation, corrective action and security significance of the event.
Results: The licensee agreed with the apparent violation. The licensee , concluded that the event was an isolated personnel failure that involved a
single element of ingress screening activities and did not represent a deficient security protection program. The licensee also concluded that the overall security significance of the event was minimal because there was no significant opportunity for exploitation.

Enforcement Conference )
An enforcement conference was held in the Region III office on 'l September 16, 1993. This conference was conducted as a result of the
findings of an inspection conducted at your Dresden Nuclear Plant on j August 25, 1993, in which an apparent violation was identified involving an inadequately conducted search at an access point that resulted in the introduction of a facsimile of an unauthorized item into the protected area.
This finding was in apparent violation of your approved security pl an. Our inspection findings were documented in NRC Inspection Reports No. 50-10/93003; 50-237/93025, and 50-249/93025 and transmitted to the i licensee by letter dated September 9, 1993.
The purpose of this conference was to: (1) discuss the apparent violation, causes, and the licensee's corrective actions; (2) discuss areas of concern; (3) determine if there were any escalating or i mitigating circumstances; and (4) obtain any additional information which would help determine the appropriate enforcement action.
! Licensee's representatives described the events which led to the j violation, its root cause, corrective actions and security / safety
significance of the event. The licensee did not contest the apparent

violation or the information provided in our inspection report referred above relating to the event. A copy of the licensee's presentation ' material is included as Appendix A to this report.
Also discussed during the conference was plant senior management's level i of sensitivity in connunicating the event to the security organization.
At the conclusion of the conference, the licensee's representatives were
informed that they would be notified in the near future of final
enforcement action.

. ' INTRODUCTION - , Acknowledgement Our purpose today is to discuss the security event . that occurred at Dresden Station on August 16*, ' 1993.

This event involved a failure to identify an
indiscernible mass on an x-ray package search. The failure allowed a facsimile of a firearm to enter
Protected Area.
' This event was an isolated failure involving a single k ' element of ingress screening activities.
Safeguards significance
The overall safeguards significance of this event is l minimal.
' Security was not significantly compromised by
introduction of the facsimile firearm.

While the admission of the facsimile on-site ' represents a security failure, there was no significant
opportunity for exploitation of the object.
This failure represents an isolated deficiency; there was no intent by the employee, to exploit the introduction of the object.

i - i ' . PROPOSED VIOLATION ' One apparent violation regarding a failure to adequately
search a hand-carried item was identified by Commonwealth Edison.
This failure resulted in the introduction of an unauthorized item into the protected area.

. . , . CHRONOLOGY Mondav AUGUST 16"'1993 * The event occurred < A Commonwealth Edison employee unknowingly introduced a facsimile of a firearm into the Protected Area of Dresden Station.
The employee reported to work and proceeded to the ingress screening area. At this time the employee's ' " hand carried item" (a duffle bag) was processed through the x-ray equipment.
' The duffle bag contained a starter'spisto/. This type of device is commonly used at the onset of races and sometimes for the training of animals.
. The following photographs were taken of the actual items obtained from the employee: Photo 'A' is the duffle bag that the employee > placed into the x-ray unit.
This bag has three compartments.
Photo 'B' is the actual starter's pistol that was
contained within the duffle bag. It has a plastic grip and is composed of a material commonly referred to as: " pot metal".
Photo 'C' depicts the pistol from the anterior of
the barrel.
NOTICE: the barre / is fu//y obstructed; rendering the pisto/ incapable of firing a projectile.

, ' . . The starter's pisto/ was not detected by the security officer working x-ray and it was allowed into the protected area.
, According to the employee, the bag (with the
starter's pistol) was stored in his " secured" locker for the entire time it was in the protected area.
Security access records indicate that the
employee was not inside the protected area for much of his work day; he was assigned to a work station outside of the protected area.
(Of the employee's approximate
hours on company property, only 2 hours were spent within the protected area).
According to the employee, no one else was
aware that the starter's pistol was in the bag.
, Based on the employee's account, his first knowledge of the event was after leaving the protected area for the day. While in the parking lot of the facility, he became aware that he had inadvertently entered the facility with the starter's pistol.
, Approximately 1 % hours after the employee became aware of his mistake, he contacted the Station
Manager to report the event.

- ' . Tuesday 8/17/93 Security reviewed reporting criteria.
The starter's pistol was not considered to be
contraband.
There was clearly no malevolent intent and the
event was deemed non-reportable; the incident was logged. This conclusion is consistent with guidance in generic letter 91-03 " Reporting of Safeguards Events".
Site investigation begins.
Security tested the x-ray units based on established procedures. An " equipment malfunction" was not a factor in the event.
. Two Officers, who were possibly involved with event, were relieved from all security duties.
Consistent with procedures, appropriate personnel were informed of the event: Corporate Security.

- .. . . . . . - _ Wednesday 8/18/93 Due to the potential significance of the event, and to maintain good communication with the NRC, Dresden informed the NRC via a courtesy ca//. At this stage, Security had not determined if the fallure was individual or programmatic; therefore, a plan for testing guard force proficiency was developed.
Corporate security discussed the event (via the telephone), with the five other Commonwealth Edison sites.
Corporate security investigation begins.
Thursdav 8/19/93 Proficiency testing of the guard force was initiated.
Initial information and materials pertinent to the investigation were gathered.
Conducted initialinterview with Commonwealth
Edison employee.
Delay in interviewing the employee was the
result of the ernployee not being available due to illness.
Security obtained the actual duffle bag and
starter's pistol from the employee.

- . A re-enactment of the event was conducted by
Security based on information gained from the CECO employee. The actual duffle bag and starter's pistol were utilized during the simulation.
Photo 'D' is a view of the duffle bag with all 3
compartments open. The bag contained clothes, papers, etc.
The starter's pistol is contained within the brown, paper bag.
Positioned: (grip down, and barrel up at a - slight angle) This information was supplied by the employee.
Photo 'E' shows how the bag and pistol may
have appeared when processed through the x-ray unit.
- Represents indiscernible mass.
Does not resemble a firearm (actual or - facsimile).
Photo 'F' illustrates an enlarged view: this is a
function that the officer could execute to produce an enhanced view of items.
The enlargement would not have clarified the indiscernible mass.

An action plan to address the event was developed.
The following topics, at a minimum, were addressed within the action plan: > Immediate actions.
Root cause analysis.
Extent of the condition (isolated or programmatic failure).
Elevated frequency for enhanced, unannounced
x-ray drills.
Survey of other utilities for enhancements to x-
ray proficiency evaluation process.
, Letter to Station personnel to clarify the protocol
associated with reporting of security events.
Corrective actions (long and short term).

The x-ray proficiency test of the entire Security Force was complete.

All three investigations had the same outcome: the employee's statements regarding the event could not be corroborated.
This is not unusual since there were no witnesses to confirm the allegation.

- , . col \\ CLUSIONS - ROOT AND CONTRIBUTING CAUSES ' A root cause evaluation assessed areas such as training, procedures, equipment, and human factors.
' . The conclusion was that the event occurred due to an isolated personnel error; the officer concurred with this conclusion.

Commonwealth Edison approached the issue ' conservatively; by acting according to the premise that the event did occur.- , .

. Short term The officers who were posted at the time of the event were immediately re-trained and re-evaluated on the x-ray unit (in accordance with training qualification standards).

Commonwealth Edison sites: Verbally informed of event. (8/18/93) > Corporate Security formally advised all Stations
of event via a letter dated (8/24/93).
. The entire guard force was proficiency tested on the operation of the x-ray unit (in accordance with training qualification standards). (8/23/93) , A notice on the topic of " timely reporting of security events" was written and supplied to all employees.

The frequency for the performance exercises has > been temporarily increased.
In order to gain data regarding different evaluation processes, Security surveyed 10 other utilities.
, Purpose was to search for possible
i enhancements to Dresden's current evaluation process for the x-ray.
Survey-was completed and reviewed (9/2/93).
- The results are being evaluated and factored into the program enhancements previously discussed.

. - S MILAR EVENTS The event was not a repeat occurrence; Dresden has not had any similar incidents in the past.
By contrast, approximately 1 year ago, an actual firearm was discovered and properly handled by an officer at the x-ray unit.

, PLANT PERFORMANCE IN SECURITY
Security's performance history has been reviewed (past i 2 years).
No concerns in ingress screening have been identified.
Dresden security has continually proven to have strong program performance through past SALP reports, QA audits, NRC audits, and other inspections.

. ~. CONCLUSION , Dresden Station recognizes the seriousness of this event.
The officer failed to identify an indiscernible mass during
the search process.
The starter's pistol was introduced to the Protected Area.
Although, it was maintained in a secured locker for the entire time.
The probability for use of the device, for assisting in radiological sabotage or the theft of special nuclear , material, was extremely minimal. The Station was not in jeopardy due to the introduction of this device.
With the focus of the event being a single element ' failure, we conclude that the corrective actions are broad, comprehensive, and will prevent a re-occurrence.
i We also feel that the following factors should be considered: The event was "self-identified".
It is a first-time occurrence at the Station.
The Station has proven performance in the ingress area.
This is not a programmatic failure.

All the presented information clearly demonstrates that Dresden has an adequate safeguards protection program.
Of course any program can benefit from enhancements, but we feel that Dresden has an acceptable operation: this isolated event does not represent a deficient safeguards protection program.
