| Description | 10 CFR 50.72(b)(3)(ii)(B) states, in part, the licensee shall notify the NRC as soon as practical and in all cases within eight hours of the occurrence of any event or condition that results in the nuclear power plant being in an unanalyzed condition that significantly degrades plant safety. Additionally, 10 CFR 50.73(a)(2)(ii)(B) requires licensees to submit a Licensee Event Report (LER) within 60 days after discovery of any event or condition that results in the nuclear power plant being in an unanalyzed condition that significantly degrades plant safety. Contrary to the above, on February 5, 2011, the licensee identified that they had failed to recognize that six unanalyzed conditions discovered during the sites NFPA 805 transition process were reportable conditions (see Section 4OA5 of this report). Consequently, the licensee failed to make an eight-hour report as required by 10 CFR 50.72, and submit LERs within 60 days, as required by 10 CFR 50.73. This finding was considered as traditional enforcement because it had the potential for impacting the NRCs ability to perform its regulatory function. The NRC has characterized this violation as a Severity Level IV NCV in accordance with Section 6.9 of the NRC Enforcement Policy. This violation was documented in the licensees corrective action program as PERs 505749, 505750, 505751, and 505752. Additionally, the licensee made an eight-hour report, and at the time of the exit, planned to submit LERs for the unanalyzed conditions. |
