~

L Dow continues'to'believe-.that-the issues framed by the Board's Order 'Concerning- Remanded . Issues dated January 4,1979 (order) (pages 6 l through.10)( can. and should be decided - from facts on the record already before-the Board. The lengthy submissions filed with the Board consist l-

{of sworn testinony, affidavits,: voluminous briefs.and memoranda.1/

H n' addition; there are cer*:ain privileged documents which were agreed'

/ to be ; privileged. or which the -Board has ruled are privileged.
