-Application to Revise Technical Specifications Regarding Secondary Containment Operability Requirements During Refueling, dated November 13, 2009 By letter dated November 2, 2007 (Reference 1), Exelon Generation Company, LLC (Exelon)(formerly AmerGen Energy Company, LLC) submitted a License Amendment Request (LAR) to revise the Oyster Creek Nuclear Generating Station (OCNGS) Technical Specifications (TS) to modify requirements related to Secondary Containment operability during handling of irradiated fuel with sufficient decay.Exelon provided additional information by letters dated May 5, 2008 (Reference 3), September 22, 2008 (Reference 6), and November 13, 2009 (Reference 8), in response to U.S. Nuclear Regulatory Commission (NRC) requests for additional information (References 2, 5, and 7)concerning this LAR. In addition, Exelon also provided supplemental information in a letter dated July 3, 2008 (Reference 4).Exelon requested the proposed changes to the TS to more effectively facilitate work and testing during refueling outages. Modifying the Secondary Containment operability requirements during handling of irradiated fuel with sufficient decay as proposed would help to improve resource allocation and possible critical path evolutions during refueling outages. The proposed changes were intended to ease the complexity of the outages around coordination of Secondary Containment operability to better manage the work and testing, and also help reduce the wear and tear on plant equipment and components during outages.After further review and evaluation, Exelon has determined that work on the Reactor Building Main Isolation Valves can be completed while the plant is operating.
In addition, for work on the Service Water and Emergency Service Water systems and Isolation Condensers, Exelon has determined that Secondary Containment penetrations can be isolated to maintain Secondary Containment integrity while performing the work.Furthermore, as OCNGS transitions to the use of new approved fuel designs (e.g., GNF2), Exelon has considered the possibility that implementation of the proposed License Amendment Request may impose some constraints on future core designs which could have an unfavorable economic impact.As a result, Exelon has determined that the proposed changes to revise the TS regarding Secondary Containment operability requirements during refueling activities are no longer necessary and hereby withdraws the License Amendment Request.
