Action Mr. Guzman,

Thanks for your reply and for clarifying the timeline and process going forward. We have some additional questions, which Ms. Azulay will be sending you, if she hasn't already.

We also would like to note that the list of event reports and shutdowns at Pilgrim in Appendix 1 should include the following event which occurred on Monday, 10/14/2013. The associated event report was not posted until today, due to the shutdown. Also, as of this morning's Plant Status Report, the reactor is still shut down. In Section 1a. of the petition, we stated that if Pilgrim operated at 100% power for the remainder of the year, it would mitigate Entergy's losses. This outage, obviously, undermines that possibility. The following information would have been included in Appendix 1 if we had had access to it:

10/14/2013 Event Number:

49441 SCRAM. Partial loss of offsite power. With 345kV line 342 out of service, a "loss of offsite power occurred due to the loss of the second 345kV line 355."

Sincerely, Tim Judson From: Guzman, Richard [mailto:Richard.Guzman@nrc.gov

RE: G20130211 - Supplement #4 to 2.206 Petition re: Immediate Action - Vermont Yankee/Fitzpatrick/Pilgrim Mr. Judson,

Thanks for your message. I have forwarded the supplemental information to the PRB. I do not expect there to be any schedule impacts in the review of your petition request due to the shutdown; however, if there are any delays for other reasons such as the need for additional information from licensees or for additional review time in response to supplemental information, you will be kept informed of the basis for the extended time and any revisions to the projected completion date. Currently, the PRB is still working towards a target date of 12/5/13 for the issuance of the proposed director's decision.

Also, please be aware that I have been reassigned to another branch and I am in the process of turning over my role as petition manager for this review to another PM, Ms. Nadiyah Morgan. I will notify you once my turnover is complete.

Sincerely, Rich Guzman DORL/NRR US NRC 301-415-1030

G20130211 - Supplement #4 to 2.206 Petition re: Immediate Action - Vermont Yankee/Fitzpatrick/Pilgrim

Dear Mr. Guzman,

Welcome back to work. I hope this finds you well and that the shutdown was not too much of a burden for you and your colleagues. It's good to have you all back on the job.

The petitioners hereby submit the fourth supplement to our March 18 petition for enforcement action. I'm sure you have a backlog of communications and other work to get through, so I will follow up to direct your attention to it. In the meantime, please let me know that you've received it. Also, the petitioners would like to know whether the shutdown is likely to affect the schedule for the review of our petition.

On behalf of the petitioners, Timothy Judson Tim Judson Associate Director Nuclear Information & Resource Service
