Dear Mr. Criscione:

November 13 , 2014 On July 8, 2014 , you sent an email to Missouri State Representative Jeanne Kirkton and copied several others including U.S. Nuclear Regulatory Commission (NRC) Chairman Allison Macfarlane (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 14232A390 , redacted version without attachments). The email was referred to the NRC's Office of Enforcement (OE). You asserted that despite having previously raised the concern to the NRC , the NRC did not evaluate the accuracy of the statements made i n the Callaway Action Request System (CARS) 200702606 document.

You alleged that licensee personnel intentionally entered inaccurate information into the quality assurance document in a continued effort to hide information from licensee management concerning the October 21, 2003 Callaway shutdown. As previously discussed with you on July 10, 2014 , the NRC OE conducted a review of the allegation files and discussed the issue with knowledgeable members of the NRC staff. The OE concluded that the staff did indeed evaluate CARS 200702606 and did not substantiate your concern. NRC records on the allegation in question contained correspondence that verified the agency's review of this document in the context of the original allegation of cover up (RIV-2007 -A-0096 , Concern 1 ). The NRC found the statements in CARS 20072606 , which were provided nearly 4 years after the 2003 event , reflected the general understanding of the operators that a shutdown sequence was in progress.

While the NRC's review of the event , as you are aware , did ultimately conclude that the operators did not effectively control reactivity during this shutdown sequence , the NRC did not conclude that the statements in the CARS document were inaccurate or intentionally misleading. As described and referenced in Chairman Macfarlane

's letter to Representative Kirkton dated July 1 , 2014 (ADAMS Accession No. ML 14139A395), the NRC has addressed your concerns regarding the October 21 , 2003 , Callaway plant shutdown multiple times through correspondence and meetings. You may disagree with some of the NRC staff's findings , but the NRC has concluded, based on its independent inspection and investigation , that there is no evidence that would indicate that there was wrongdoing , such as a cover-up , concerning the shutdown event. In the absence of new information, there is no regulatory or safety basis for the NRC to expend further resources related to the October 21 , 2003 , Callaway plant shutdown. Therefore, the NRC has closed th i s matter , and the staff plans to provide no additional feedback regarding this issue.
