DearMembersoftheBoard,

Intervenors wishtoadvisethepartiesandmembersoftheBoardthatforgoodandsufficient reasontheypresently willnotbeabletopresentthedirecttestimony ofRobertPollardoftheUnionofConcerned Scientists atthehearingscheduled forDec.11,1979.Intervenors willparticipate andwillpresenttheircasethroughcrossexamination andinterrogatories.

Intervenors hadadvisedcounselfortheStaffandtheapplicant informally bytelephone priortotheNov.16,1979deadlineforfilingwrittentestimony, thatthiswouldbethelikelyoutcomeofanyeffortbytheIntervenors topresentMr.Pollard's testimony inadirectcase.TheIntervenor+

furtheradvisedthepartiescounselthattheirdecisionnottopresentdirecttestimony wassubjecttoreviewuponexamination oftestimony ofPatrickW.Baranowsky tobefiledbytheStaffonNov.9,1979andwhichwasreceivedbytheIntervenors forthefirsttimeFriday,Nov.16,1979.Thattestimony isnowunderreviewbyIntervenors.

Thesubjecttestimony involvedprobabilistic analysis.

Inaddition, Intervenors propoundtheattachedinterrogatories totheutilityinanefforttodevelopacompleterecordonFPL'shistoryofon-siteandoff-sitepoweravailability soastoaid,theAppealBoardintheirdeliberations ontheseissues.Finally,INtervenors areattempting toobtainthetestimony ofDaleBridenbaugh ofMBHAssociates ofSanJose,California sincehehasperformed ananalysisofthesafetyimplications oftheproblemsassociated withtheon-sitepowerfailuresattheSt.LucieplantandMr.Baranowsky's probabilistic analysistestimony.

IfIntervenors obtainMr.Bridenbaugh's servicesitwillbetoolatetoprefilehistestimony.
