Dear Chairman Bloch:

As you know, on January 13, 1982, Parsons &

Whittemore, Inc. and Resources Recovery (Dade County) ,

Inc. (collectively, " Parsons & Whittemore") filed with the Board an amicus brief and proposed license conditions in order to safeguard its position as a small power producer against FP&L's monopoly power and to preserve for such producers the opportunity for free competition with FP&L. This submission w-a filed pursuant to the Board's decision last summer to grant Parsons & Whittemore status as amicus curiae to present arguments concerning the relief to be fashioned upon a finding that a situation inconsistent with the antitrust laws exists.

As we understand it, since Parsons & Whitte-more filed its brief and license conditions, all proceedings in this docket have been suspended pending possible settlement between FP&L and Florida Cities.

While Parsons & Whittemore is not privy to the negotia-tions, any settlement of issues concerning license conditions will directly affect its interests as a C)g competitor of FP&L.
