Florida Power & Light Co. (St. Lucie Plant, Unit No. 2), Docket No. 50-389A
Dear Judge Bloch:
Enclosed is a Stipulation which records the agreement of FPL and the Cities that the operating license for St.
Lucie Unit No. 2 may issue notwithstanding the pendency of antitrust review proceedings.
Also enclosed, for the Board's information, is a Settlement Agreement that has been negotiated between attorneys and representatives of the Cities and FPL and recommended by them to their principals.
FPL has executed the Settlement Agreement, and, according to its terms, it will become effective if approved by the governing body of each individual City.

am informed by counsel for the Cities that six Cities and the Florida Municipal Utilities Association have approved the
@f Settlement Agreement.
All other Cities are expected to con-I sider it by March 3, 1982.
The Settlement Agreement provides for resolution of all disputes between FPL and the Cities.

in a case pending in federal court in Miami, and contains certain agreements regarding the rates and terms and conditions for power sales and transmission service transactions that are subject to the jurisdiction of the Federal Energy Regulatory Commission.

Peter B. Bloch, Esquire February 22, 1982 Page Two FPL and Florida Municipal Power Agency ("FMPA") have also executed.a participation agreement for St. Lucie Unit No. 2.
An application for an amendment to the construction permit to permit transfer of an ownership interest to FMPA will be submitted in the near future to the Director, Nuclear Reactor j
Regulation.
The parties will report to the Board shortly after March 3, 1982, on the status of efforts to conclude a settlement.
