STATEMENT

Czech Office of Occupational Safety

of 31 May 1991,

amending and supplementing Decree No 76/1989 Coll. of the Czech Labour Safety Authority on ensuring the safety of technical equipment in the nuclear power industry

The Czech Labour Safety Authority shall determine, pursuant to Section 5(1)(d) and (f) of Act No.

174/1968 Coll., on State Profession al Supervision of Labour Safety, in agreement with the relevant central authorities:

Article I

Decree No 76/1989 Coll. of the Czech Labour Safety Authority on ensuring the safety of technical equipment in the nuclear power industry is amended as follows:

1. In Article 1(1), the words 'dedicated technical' shall be inserted after the words 'and import'.
2. In § 1(2), point (d) is deleted.
3. Section 2(1) reads as follows:

"(1) The builder is obliged to submit t o the competent authority of the state professional supervision over safety at work (hereinafter referred to as the "supervisor y authority")2 )

a) at least 30 days before the submission of the application for a planning permission, a draft specification for the construction,3 )

(b) at least 30 days prior to submitting an application for a building permit, the construction project,4 )

(c) at least 30 days before the commencement of construction work, documentation of the construction design,4a ) requested by the supervisory authority,

(d) at least 3 months before the first loading of fuel into the reactor

1. pre-operational security report,5 )
2. the commissioning programme,

(e) at least 30 days prior to the submission of the application for the issuance of the approval decision 5 ),

evidence of the registration of the installation pursuant to Section 12.".

4. In § 3, point (f) is deleted. The existing points (g), (h) and (i) are renumbered as points (f), (g) and (h).
5. The first sentence of Section 4(1) reads "The competent design organisation shall, when preparing the construction project, draw up a list of the facilities referred to in Section 1(2) and submit it to the supervisory authority before it is handed over to the builder."
6. Section 4(2) reads as follows:

"(2) The builder is obliged to ensure, in cooperation with the relevant contractors, that the relevant design organisation specifies, extends or makes further modifications and changes to the list of equipment and changes to their classification into safety classes on the basis of any changes to the construction project."

7. In Section 5(1), the words 'to carry out the installation, reconstruction and repair of the equipment referred to in Section 1(2)(d),' shall be deleted.
8. In Section 5(3), the following point (f) is added:

'(f) the manner in which the activities referred to in paragraph 1 are to be inspected by an independent authority.'.

9. In § 6(2), points (b) and (c) shall read:

'(b) strength calculations and relevant technical data drawn up in accordance with the relevant technical standards, technical conditions or, where appropriate, new developments in science and technology, unless the organisations concerned agree otherwise with the supervisory authority,

(c) calculations and relevant technical data on the parameters of the safety devices (type, size, permeability, location, etc.),'.

10. In § 7(1), point (b) is deleted. The existing point (c) shall be renumbered as point (b).
11. In Section 8, paragraph 4 is deleted. The existing paragraphs 5 and 6 are renumbered as paragraphs 4 and 5.
12. in Section 10(1), the words 'parts and materials' shall be inserted after the words 'output tests of equipment,'.
13. in Article 10(2), point (b) is deleted.
14. in Section 10, the following paragraph 6 is added:

"(6) Written evidence of the acts performed under subsection (1) shall be acknowledged by the officer by signature and the registration number of the certificate issued.".

15. In § 15, paragraph 3 is deleted.

Article II

This Decree shall enter into force on the date of its promulgation.
