Dear Stuart Rymer:

The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated February 28, 2024 (Agencywide Documents Access and Management System Accession Number No. ML24059A369) and supplemented on March 18, 2024 (ML24078A257). The proposed action would allow Tennessee Valley Authority to load MPC-37-CBS in the HI-STORM FW MPC Storage System at the Watts Bar Units 1 and 2 ISFSI in the storage condition where the terms, conditions, and specifications in CoC No. 1032, Amendment No. 0, Revision No. 1 are not met, solely as it applies to the near-term planned loading of five non-compliant CBS canisters beginning in July 2024. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations (10 CFR) Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i);

72.212(b)(11) and 72.214.
