Dear Mr. Thompson:

By letter dated September 28, 2023 (Agencywide Documents Access and Management System Accession No. ML23271A063), the Tennessee Valley Authority (TVA) submitted exemption requests for the Browns Ferry Nuclear Plant, Units 1, 2, and 3, the Sequoyah Nuclear Plant, Units 1 and 2, and the Watts Bar Nuclear Plant, Units 1 and 2. The requests seek exemption from the requirement use a locked door or gate with monitored alarm at the access control point for the storage facilities at the Browns Ferry, Sequoyah, and Watts Bar sites, where either steam dryers or steam generators are stored.

The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of the exemption request. The acceptance review was performed to determine whether the scope and depth of the technical information was sufficient to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with paragraph 37.11(a) of Title 10 of the Code of Federal Regulations (10 CFR), the Commission may, upon application of any interested person or upon its own initiative, grant such exemptions from the requirements of the regulations in Part 37 as it determines are authorized by law and will not endanger life or property or the common defense and security, and are otherwise in the public interest.

The NRC staff has reviewed TVAs request and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the exemption request. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

Based on the information provided in TVAs submittal, the NRC staff has estimated that this licensing request will take approximately 144 hours0.00167 days <br />0.04 hours <br />2.380952e-4 weeks <br />5.4792e-5 months <br /> to complete and that the review can be completed by June 30, 2024. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates will be communicated, during our routine interactions. These estimates are based on the staffs initial review of the request, and they could change due to several factors such requests for additional information or the need to perform an audit.
