ACCEPTANCE OF TRISO-X, LLC REQUEST FOR AN EXEMPTION FROM PORTIONS OF TITLE 10 OF THE CODE OF THE FEDERAL REGULATIONS 73.67(D) AND (E) FOR PHYSICAL SECURITY (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2023-LLE-0012)

Dear Jennifer Wheeler:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its acceptance review of your application requesting an exemption certain physical security requirement in Title 10 of the Code of Federal Regulation (10 CFR) 73.67(d) and (e), submitted via letter dated April 21, 2023, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23111A263). The NRC staff did not identify any administrative omissions or deficiencies and determined that the application provides sufficient information to proceed with detailed technical review. The renewal application has been assigned Enterprise Project Identification Number L-2023-LLE-0012. Please reference this number and Docket Number 07007027 in any future correspondence associated with this request.

Please note that the NRC staffs technical review of your application may identify the need for additional information. Based on the preliminary evaluation of your application and our review schedule projections, we anticipate completing our formal review by September 29, 2023. Our projected schedule includes the issuance, if needed, of a request for additional information (RAI) by the end of July 2023. Please note that these dates could change depending on the findings of our technical review, urgent assignments, or other factors, such as whether your responses to the RAI resolve the issues. The NRC staff estimates that completing the review of your submittal will require approximately 100 staff hours which corresponds to about $29,000.00 (at $ 290.00/hr). We will promptly communicate significant schedule and/or cost changes, if any.
