Dear Mr. Latimer:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated February 10, 2020, addressed to Secretary Annette L. Vietti-Cook, regarding the proposed Indian Point Energy Center (IPEC) license transfer from Entergy Nuclear Operations, Inc. to Holtec Decommissioning International, LLC. In your letter, you request that the NRC (1) extend the public comment period for the license transfer application from 30 days to 60 days and (2) hold a local public hearing regarding the application.

Regarding your request to extend the public comment period, the NRC has extended the public comment period by 30 days. The 60-day comment period will end on March 25, 2020. Notice of this extension was published in the Federal Register on February 19, 2020 (see Docket ID: NRC-2020-0021 in Regulations.gov).

Regarding your request to hold a local public hearing regarding the application, I would like to elaborate on the difference between two agency processes associated with public engagements. One is a legal proceeding conducted in accordance with the rules of practice established in 10 CFR Part 2 and generally presided over by NRC administrative judges. The other is a public meeting conducted by the NRC staff. The NRC intends to hold the latter in the coming months to discuss plant performance at IPEC and other areas of interest within the NRCs purview. During this meeting the NRC staff will be prepared to discuss the license transfer application review process. There will be a public question and answer period to ensure that concerns presented by interested stakeholders are considered by the NRC. As done in previous years, the NRC also plans to hold a separate meeting with elected officials before the annual assessment meeting.
