OFFICE OF NUCLEAR REACTOR REGULATION SUPPORTING THE ORDER TERMINATING CONSTRUCTION PERMIT NO. CPPR 154 WASHINGTON PUBLIC POWER SUPPLY SYSTEM AT THE WNP-3 SITE l

DOCKET NO. 50-508 l

1.0 INTRODUCTION

l This safety evaluation supports a U.S. Nuclear Regulatory Commission (Commission) order to terminate Construction Permit No. CPPR-154, which authorized construction of the Washington Nuclear Project Unit 3 (WNP-3), located at Satsop, Washington. The ,

construction permit (CP) held by the Washington Public Power Supply System (the Supply l System) includes all remaining WNP-3 structures and the Washington Nuclear Plant Unit 5 l (WNP-5) structures subsumed in the WNP-3 construction permit following expiration of I the WNP-5 Construction Permit No. CPPR-155, which was issued on April 11,1978, Docket No. 50-509. l The Supply System requested termination of the construction permit in a letter dated August 8,1996, as supplemented by letters dated June 15 and November 5,1998. In a related matter, on August 16,1996, the Supply System filed a motion for withdrawal of its application for an operating license (OL) for WNP-3 and for termination of the proceeding before the Atomic Safety and Licensing Board (ASLB). The ASLB granted the motion for withdrawal of the OL application and terminated the proceeding on October 16, 1996, noting that the staff would prepare an adequate environmental assessment (EA) on the CP termination, encompassing OL termination impacts.

2.0 EVALUATION On October 27-28,1998, headquarters staff inspected the Satsop site to (1) examine the environmental condition of the site, (2) evaluate the potential environmental impact (excluding monetary and social) on the offsite environment of abandoning construction of the nuclear power plant, (3) determine whether the stabilization plan submitted by the Supply System considered all critical areas, (4) assure that partially completed structures would cause no danger to the public or to site users, and (5) verify that the nuclear steam the Supply System has been rendered inoperable for purposes of nuclear power production. These inspections were recorded in Inspection Report No. 50-508/98-01 and an EA.

The site never received either nuclear fuel or nuclear sources. The Commission found no contamination; therefore, the site complies with the criteria of Regulatory Guide 1.86, Table 1, which specifies acceptable contamination levels for unrestricted use of reactor facilities. Further, there was no evidence of direct radiation levels, thereby easily meeting 9902010189 990122 PDR ADOCK 05000508 P PDR

Memorandum "SECY 92-106-Action Plan to Ensure Timely Remediation of Sites Listed in l

the Site Decommissioning Management Plan," April 6,1992). On the basis of these findings, the facility can be released for unrestricted use and the CP can be terminated.

3.0 ENVIRONMENTAL CONSIDERATION

The Commission has prepared an environmental assessment (EA), which was published in the Federal Register on January 11,1999 (64 FR 1644). On the basis of the EA, the  !

Commission has determined that no environmental impact statement is required and that i issuance of this order terminating the CP will have no significant adverse effect on the quality of the human environment.

4.0 CONCLUSION
