DRAFT SPCCIAL SAFEGUARDS II'.PLEMEllTATION REPORT (SSIR) l The attached report has been orepared in response to the Comission's rc:tuest for'a. staff review of the SSIR.

The report (1) focur.es on the background and nurposes of the SSIR, ?!RC involvement, the cresent status of the prototype report, an overall l assessnent, and innlications for flRC's activities in export licensing

and interagency liaison,. including interactions with respect to the US effort to upgrade international safeguards
and (2) includes I; MSS' technical analysis of the SSIR.

l The staff concludes that (1) additional restrictions on US export acti-i- vities are neither necessary nor desirable at this time: and (2) the most imediate end imortant innlication of the draft SSIR for IRC is the need to ensure that the SSIR cxcrcise and other activities succeed in establishing an effective and up-to-date infornation flos on the IAEA safeguards procraa and on any fundamental oroblems. As for other possible flRC measures with respect to the deficiencies identified in the draft SSIR, the forthcomina staff report on liRC's role and involvenent in international safeguards efforts will consider these aspects in further detail.

In addition to reconmondina that the Comission note the review and its l

-2 o The US places hiph value on the effort to provide the Board of Governors with periodic reports on safenuards implementation and effectiveness. I o It is important to ensure that the IAEA include in these re-ports the most up-to-date and complete information possible and identify remedial actions taken as well as other measures which will be taken to correct deficiencies.

l o The NRC has a keen interest in the efforts to upgrade IAEA i safeguadds and will continue to particioate actively with 4 the other US government agencies (includinn the present effort to define the technical assistance program under the $5 million .

grant-in-kind). '

o Because of its experience in renulatory matters, the NRC expects to make valuable contributions and, in the context of the inter-agency effort, to continue its liaison with the IAEA.

o The NRC has a direct interest in the IAEA safeguards effort be-cause of the Commission's export licensing responsibilities. The stability and predictability of export licensinq depends on the IAEA doing an effective job and on the US having a complete and l' current assessment of the IAEA safeguards program. -

o The Comission would like to reinforce the US expectation that ,

the Board of Governors is to be advised whenever there is any ,

fundamental problem (such as consistent non-cooperation by a  !

country) in the application of safeguards. -

The information availabic to the Board should include, on a con- I fidential basis as necessary, identifying details so that the i US understands exactly where and what the problems are. ilhile < 1 this informttion may or may not be an integral cart of the SSIR exercise, it is important that it be made available on a timely  !

basis.

(Ambassador Tape noted this exnectation in his recent AIF speech.

As noted in the attached report, the staff concludes that this expectation should be reinforced in our interagency liaison, among other itens.)

o The Comission considers the Agency to be at a carticularly important period, in terms of strengthening safeguards, estab-lishing certain standards, ensuring uniform apolication of procedures (including containment and surveillance techniques),

4 and taking forceful positions wherever non-cooperation prevents effective application of safeguards measures.

HMSS and OPE have concurred in this memorandum and the attached staff review.
