NOTICE OF DEVIATION Detroit Edison Company Docket No. 050-341 Fermi 2 License No. NPF-43 During an NRC special inspection conducted on November 13,1997, through February 26,1998, a deviation of one of your Updated Final Safety Analysis Report (UFSAR) commitments was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the deviation is listed below:

Appendix A of the Fermi 2 UFSAR includes a commitment to Regulatory Guide 1.25,

" Assumptions Used for Evaluating the Potential Radiological Consequences of a Fuel Handling Accident in the Fuel Handling and Storage Facility for Boiling and Pressurized Water Reactors."

Regulatory Guide 1.25 (1972) lists assumptions to be used to evaluate the radiological consequences of postulated fuel handling accidents in order to evaluate the adequacy of the design of the fuel handling and storage facility. Regulatory Position 1.c in Regulatory Guide 1.25 specified the minimum water depth between the top of the damaged fuel rods and the fuel pool surface as 23 feet. Related footnote 2 stated that for release pressure greater than 1200 psig and water depths less than 23 feet, the iodine decontamination factors will be less than those assumed in this guide and must be calculated on an individual case basis using assumptions comparable in conservatism to those of Regulatory Guide 1.25.

Contrary to the above, the licensee stored irradiated fuel in the west fuel preparation machine in the spent fuel pool ovemight on November 14-15,1997, and November 15-17,1997, resulting in only 20.5 feet of water above the top of the fuel without performing the required evaluation of potential radiological consequences.

Please prevkie to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the facility that is subject of this Notice, in writing within 30 days of the date of this Notice: (1) the reason for the deviation, or if contested, the basis for disputing the deviation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further deviations, and (4) the date when your corrective dion will be completed. Where good cause is shown, consideration will be given to extending the response time.
