SUBJECT: NOTICE OF VIOLATION, NOTICE OF DEVIATION, AND SPECIAL INSPECTION

REPORT NO. 50-341/98004(DRP)

Dear Mr. Gipson:

On February 26,1998, the NRC completed a specialinspection of the activ!iles completed by

licensee personnel to inspect and move failed irradiated fuel at your Fermi 2 reactor facility. The

enclosed report presents the results of that inspection

Overall, our inspection indicated that the activities pt .ed to move and inspect failed fuel

were completed in a safe manner. However, a number of deficiencies were identified in the

areas of administrative control, criticality controls, procedure adequacy, and translation of design

and licensing bases into design and operating documents. In addition, the decision-making

during the performance of activities to move and inspect failed fuel was observed by the

inspectors to be informal at times. Also, management did not close?y oversee the planning and

execution of this work, and was not involved in the resolution of NRC identified issues. As a

result, the response to NRC concems was slow and the regulatory significance of the issues was

not initially recognized by your staff. We are also concemed by your staff's excessive reliance on

vendor expertise and procedural controls without thoroughly evaluating their adequacy. i

Based on the results of this inspection, the NRC has determined that two violations of NRC

requirements occurred. These violations are cited in the enciosed Notice of Violation (Notice)

at the circumstances surrounding them are described in detail in the subject inspection report. j

The first violation is a concem because administrative controls were not established to prevent i

inadvertent criticality during the simultaneous removal of multiple fuel rods from a bundle. The

second violation involved an inadequate fuel inspection work request that lacked the necessary

controls to accomplish this complex activity, resulting in unclear roles and responsibilities.

Additionally, a deviation from a commitment was identified. The deviation was of concem

because your staff did not recognize or assess the effect of reducing the level of water above a

fuel assembly prior to storing fuel in the fuel preparation machine.

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notices when preparing your response. The NRC will use your response, in part, to

determine whether further enforcement action is necessary to ensure compliance with regulatory

requirements.
