Dear Sir:

Pursuant to Reference (c), Public Service Company of New llampshire et al, hereby modifies the prior request for partial exemption from the require-g ments of 10CFR50 Appendix A. General Design Criterion 4 (CDC-4) as provided

, Attentient- Mr. H. R. Denton Construction Permit - Paragraph 3 This permit shall be deemed to contain and be subject to the con-ditions specified in Sections 50.54 and 50.55 of said regulations; is subject to all applicable provisions of the Act, and rules, re-gulations, and orders of the Commission now or hereaf ter in ef fect except to the extent applicants obligations thereunder may be modi-fled by duly authorized exemptions, and is subject to the conditions specified or incorporated below:

Construction Permit - Paragraph 3.C This construction permit authorizes the applicants to construct the '

facility described in the application and the hearing record, in ac-cordance with the principal architectural and engineering criteria

~(except to the extent modifications of such criteria may be duly authorized by exemption), and environmental protection commitments set forth therein.

In brief, if the amendment were granted, it would afford the Permittees partial exemption from 10CFR50, Appendix A, General Design Criterion 4 (GDC-

4) as it applies to the postulation of longitudinal and circumferential pipe breaks in the Reactor Coolant System primary loop piping (hot leg, cold leg, and crossover leg piping). The effect said amendment would have on plant de-sign (e.g. eliminate pipe whip restraints), the benefits and the technical foundation for Permittees' request has been discussed in detail in Reference (c) and (d) which are hereby incorporated by reference into this application.

In order that activities related to this issue (e.g. Class 1 piping functionality - SER Open Item #5) are not affected, we request written noti-fication, that our exemption request has been granted by July 31, 1985.

The application fee (150.00) required by 10CFR170.12(c) is remitted herein.
