Request for Renewal of Construction Permits and Extension of Construction Completion Dates l

Dear Sir:

I l Pursuant to the Atomic Energy Act of 1954, as amended, and the

Commission's Rules and Regulations thereunder, Public Service Conpany of New l Hamps hire (PSNH), on behalf of itself and the other licensees named in the above Construction Permits, hereby requests that said Co nstruction Permits be amended and renewed by extending the dates for completion of construction as set forth therein, f rom June 30, 1983 and October 31, 1984 to June 30, 1986 aad October 31, 1988, respectively.

This request was previously included in Amendment 40 to the Application to Construct and Operate Seabrook Station, as filed on May 14, 1979. However, the request was not acted upon by the Commission at that time. Note that this request cupplements the request included in Reference (c).

The applicants submit that good cause for granting these extensions exists because construction has been delayed due to the following factors: ggi))

1. The original dates for completion were set forth in the Application as I filed on March 30, 1973. The record in the above dockets is replete with evidence which substantiates the significant delays which occurred prior d(k gW ()

United States Nuclear Regulatory Commission May 26, 1983 Attention: Mr. Harold Denton, Director Page 2 to issuance of the permits in July,1976, and the two cessations of construction which were subsequently ordered as a result of regulatory conflicts between federal agencies, including a four-month suspension in 1977 and a three-week suspension in July,1978, each of which resulted in delay for restartirs as well.'

2. Changes in the scope of the project, including increases in the amount of material and engineering required as a result of regulatory actions, in particular, those since TMI.
3. Construction delayr and lower than estimated productivity have slowed the installation of material and equipment.
4. Construction slowdowns necessitated by State regulatory actions.

, All of the foregoing factors have combined to slow progress on the construction of the units and to make the originally estimated completion dates no longer viable or realistic. The re fore, the applicants request the extensions referred to above.

This request (three signed originals, under oath, and forty-five copies) is being submitted by PSNH on behalf of all the current participants in the Project. Copies of the Appointment of Agent forms authorizing PSNH to act on behalf of the participants have been previously filed in the above dockets.

Pursuant to 10 CFR Section 170.22 and in accordance with the determination made with respect to Amendment 39 in the above dockets, applicants propose that this request constitutes a Class III application involving a single issue, duplicated in a second docket, and, accordingly, a check for $4,400 is enclosed herewith to cover the filing fee.
