PETITION OF CITY OF BROOK PARK, OHIO FOR LEAVE TO INTERVENE Pursuant to the Director's Notice of the denial of the above-identified licensees' applications for amendments to their operating licenses (56 Fed. Reg. 20057, May 1, 1991),

the City of Brook Park, Ohio (" Brook Park") petiticns to intervene and participate, as described below, in any hearing demanded by Iicensees, Ohio Edison, et al.

l l Brook Park recently initiated a study of the feasibility of establishing a municipal electric system. As a municipality located within the control area of the Cleveland Electric Illuminating Company ("CEI"), a Brook Park municipal electric system would need to obtain some or all of several services from CEI including (but not necessarily limited to) interconnection, wholesale power sales, and wheeling services.

The entitrust conditions currently in the license require CEI' to make these services available on reasonable terms and conditions as stated in the conditions. Toledo Edison Co. eV alz, 10 NRC 265 (1979) at 296-99. If the license is amended to remove these conditions, there is no assurance tnat Brook Park can obtain these services from CEI or its co-licensees.

Accordingly, Brock Park has an interest in this proceeding that cannot be adequately represented by any other party, and hereby requests that it be made an intervenor, with full rights of participation.

Brook Park cpposes the requested amerdment for the reasons stated by the NRC Staff in its denial dated April 24, 1991 and stated in the pleadings or comments filed by the City of Clyde, Ohio (dated February 5 and July 15, 1988), the City of Cleveland, Ohio (dated February 19 and September 13, 1988),

American Municipal Power-Chio, Inc. (dated April 6 and July 13, 1958), and the American Public Power Association (dated July 15, 1988). Further, Brook Park opposes a hearing in this I

l proceeding for the reasons stated by the City of Cleveland in its pleadings dated May 31 and July 10, 1991.

WHEREFORE, for the reasons stated above, Brook Park requests that the Nuclear Regulatory Commission and the Atomic Safety and Licensing Board deny Applicants' request for a hearing.

Brook Park further requests that, if a hearing is ordered, this petition to intervene be granted and that Brook Park be admitted to the proceeding with full rights of a party.
