SUBJECT:

PRAIRIE ISLAND NUCLEAR GENERATING PLANT (OFFICE OF INVESTIGATIONS REPORT NO. 3-2002-022)

Dear Mr. Solymossy:

This refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC)

Office of Investigations (OI) on April 7, 2003, to determine whether an electrician deliberately provided incomplete and inaccurate information to the Nuclear Management Company (NMC) to obtain unescorted access to the Prairie Island Nuclear Generating Plant during August 2001.

Based on the information developed during that investigation, OI concluded that the individual deliberately failed to fully disclose his entire criminal background history on his personnel security questionnaires. Further, the individual mischaracterized the reason he was terminated by at least two employers and he claimed an academic degree that had not been awarded to him. Your staff identified this apparent violation of NRC requirements and took immediate corrective actions. Therefore, after coordination with the Director, Office of Enforcement, and in accordance with the General Statement of Policy and Procedures for NRC Enforcement Action (Enforcement Policy), NUREG-1600, no enforcement action is being taken against NMC in this matter. The synopsis of the OI report is enclosed.

SYNOPSIS This investigation was initiated on September 3, 2002, by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region III (RIII) to determine if a contract electrician deliberately falsified his access authorization application at the Prairie Island Nuclear Generating Plant.

Based upon the evidence developed during this investigation, it was substantiated that a contract electrician deliberately falsified his access authorization application.
