On January 6, 1982, Intervenors' counsel, pursuant t Appeal Board's Order of December 29, 1981, provided an explana-i

! tion of his representational status. Applicant has no comment with respect to that response. However, Intervenors thereafter seek to raise additional matters apparently in support of their outstanding Motion of December 8, 1981 to " Consider New Evidence and Reopen the Proceedings."

Applicant herein sets forth its opposition to the presenta-tion of those additional matters. The Commission's regulations provide for the filing of motions, such as that filed by Intervenors on December 8, 1981 (10 CFR S2.730 (a)) , and for the submittal of responses by the non-moving parties. (10 CFR S2.730 (c) ) .1! However, the Commission regulations do not provide a subsequent opportunity for the moving party to bolster its position. For this reason Applicant requests gSC>3 3 \
