APPLICANT'S RESPONSE TO INTERVENOR PLEADINGS On April 20, 1981, Applicant received *two documents from the Intervenors; one being dated April 16, 1981 and captioned Intervenors' Response and the second being an April 12, 1981 letter from Mr. David Springer to Dr. John Buck.

With respect to Intervenors' Response, Applicant maintains that the Com-mission's regulations, of which Intervenors' counsel is well familiar, does not provide for a response and thus the docu-ment should be stricken.

See The Detroit Edison Company (Enrico Fermi AtomicsPlant, Unit 2), ALAB-4 69, 7 NRC 4 70 (1978).

In any event, Applicant does not make the concessions alluded to in the Response; rather, it rests on its pleading filed on April 13, 1981.

With respect to Mr. Springer's letter, Appli-cant does not object to Items 1 and 2 herein.

However, Item 3 can only be characterized as additional rebuttab argument.

Inasmuch as the oral argument was completed April 1, 1981, no other argument should be permitted and Item 3 should be stricken.
