RESPONSE TO NRC.-STAFF MOTION TO

- EXTEND TIME UNTIL FURTHER ORDER

-The'NRC Staff's motion dated. February 7,.1978, seeks an indefinite' extension.of time in which to file further pleadings -on. substantive issues - and to respond to pleadings which.have already been-filed. Myron M. Cherry opposes this motion-insofar.as it pertains _to motions which have pre-viously been submitted.

-for.Mr.-Cherry requested that jurisdictional motions be due l on February 28, 1978'. This request was strongly opposed by l th'e Staff and the Board imposed a filing deadline of February.

l In accordance with this Board's orders, in the last several weeks various motions have been filed'on behalf ofJ.

Mr. Cherry, the Saginaw'Intervenors, and Messrs. Tourtellotte and Grossman. In the case of certain of these motions,~the time for the Staff.to respond has already elapsed.

We agree that the parties should abstain from filing any new motions until the status of these proceedings is clarified ~. However, we see no reason to exempt tho Staff k

.1 from dealing with matters which already have been formally '

raised.

i The~ Staff has suggested that the jurisdictional issues i

are simple and their. proper resolution abundantly clear. (Id. I at 56, 59, 64, 76.) This point of view and any others espoused by the parties should be put on record at this time so that l
