THE UNIVERSITY OF TEXAS AT AUSTIN REQUEST FOR ADDITIONAL INFORMATION, RE: REQUESTED CHANGES TO THE FACILITY OPERATING LICENSE FOR THE UNIVERSITY OF TEXAS AT AUSTIN (TAC NO. ME8076)

Dear Mr. Whaley:

We are continuing our review of your amendment request dated January 9, 2012, for Facility Operating License No. R-129 for the University of Texas at Austin Research Reactor. During our review of your amendment request, questions have arisen for which we require additional information and clarification. Please provide responses to the enclosed request for additional information within 30 days of the date of this letter.

In accordance with Title 10 of the Code of Federal Regulations Section 50.30(b), your response must be executed in a signed original under oath or affirmation. Your response must be submitted in accordance with 10 CFR 50.4, Written Communications. Information included in your response that is considered security, sensitive, or proprietary, that you seek to have withheld from the public, must be marked in accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding. Following receipt of the additional information, we will continue our evaluation of your amendment request.

R-129; DOCKET NO. 50-602 We are continuing our review of the application for license amendment for authorization of additional special nuclear materials (SNM) and byproduct materials related to reactor operations or reactor-based research for the University of Texas. Your request is being reviewed in accordance with the applicable guidance provided in NUREG-1537, Guidance for Preparing and Reviewing Application for the Licensing of Non-Power Reactors. During our review questions have arisen for which we require additional information and clarification.

Please provide responses to the following requests for additional information (RAI) within 30 days of the date of the letter.

1. The Facility Operating License for the University of Texas at Austin states that the licensee is licensed to receive, posses, and use Special Nuclear Material in connection with the operation of the facility [section 2.B(2)] and Byproduct Material in connection with the operation of the facility [section 2.B(3)]. This includes the associated reactor research program (experiments).
a. For materials directly related to the operation of the facility, please discuss how you plan to use the materials that you are requesting to add to the license.
b. For materials directly related to the reactor research program (experiments), please discuss how you plan to use the materials that you are requesting to add to the license.
c. Please specify if the materials are going to be used as part of a currently approved procedure or as part of an approved or planned experiment. Please identify which procedure(s) or experiment(s).
