1. Upon his return from a prehearing conference in another NRC matter on August 12, 1981, counsel for the Applicants herein learned that the Appeal Board had scheduled oral argument on the exceptions taken to the Partial Initial Decision in this matter for Tuesday, September 1, 1981, at 9:30 a.m. in Bethesda, Maryland.
2. By ea order issued August 3, 1981, the Licensing Board

-in this matter has scheduled a prehearing conference to be held that same day with respect to certain of the remaining issues k

still within the' jurisdiction of the Licensing Board presumably to be. held in Boston, Massachusetts.

3. The Applicants take no position as to which of these proceedings should go forward on the date of September 1, 1981, but are only interested in resolving the conflict that now exists.

WHEREFORE, the Applicants respectfully move both the Appeal Board and the Licensing Board to issue an appropriate order or other directive to assure that the prehearing conference and the appellate argument 1.ow scheduled for September 1, 1981, will not be held on the same day.
