OF CERTAIN EMERGENCY s;3ac3 GM PLANNING CONTENTIONS 4 The Commonwealth hereby notifies the Board and all parties to this proceeding that, on the basis of the Applicants' revised evacuation study (" Evacuation Time Estimates Supplement Pilgrim Station 1990," Prepared by HMM Associates, August 19, 1981) and on the condition that said study is incorporated into the Applicants' PSAR, the Commonwealth is able to withdraw the following portions of its Detailed Statement of Emergency Planning Contentions filed on August 21, 1981:

1.Section II, Paragraph F, Subparagraphs 2, 4, and 5;
2. Sec& ion II, Paragraph G and Subparagraphs 1-10 thereof; 9so3 s '
3.Section II, Paragraph H; and /

4. The references in Section II, Paragraphs I and J to the evacuation time estimates calculated by Battelle Pacific Northwest Laboratories for the NRC Staff.

The above items relating to the CLEAR model evacuation time estimates included in SER Supplement No. 5 are withdrawn becau- of the irrelevance of that study in light of the

! Applicants' revised evacuation study. The' Commonwealth reserves its right to challenge any revised evacuation study performed by or for the NRC Staff and addressed in the Staf f's testimony.
