APPROVAL OF CENTRUS ENERGY CORP. REQUEST TO REMOVE THE REQUIREMENT FOR IT TO MAINTAIN AN EMERGENCY PLAN FOR THE AMERICAN CENTRIFUGE LEAD CASCADE FACILITY

Dear Ms. Wiehle:

By letter dated October 17, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19312A443), Centrus Energy Corp. (Centrus) requested the U.S.

Nuclear Regulatory Commission (NRC) to remove the license requirement for Centrus to maintain an emergency plan for the American Centrifuge Lead Cascade Facility (LCF).

Centrus justification for requesting the change is that it has decommissioned the LCF and determined that no significant radiological materials remain in the LCF areas, as documented in its Final Status Survey Report (FSSR) dated April 19, 2018 (ADAMS Accession No. ML18145A127). In response to a Centrus request dated June 18, 2019 (ADAMS Accession No. ML19172A105), the NRC approved the FSSR on September 23, 2019 (ADAMS Accession No. ML19228A087), thereby confirming that the LCF areas comply with the NRCs free release criteria of Title 10 of the Code of Federal Regulations (10 CFR) Part 20. As addressed in the NRCs safety evaluation report (ADAMS Accession No. ML19228A097), the FSSR approval was partially based on the results of a confirmatory radiological survey of the LCF conducted by the Oak Ridge Associated University in May 2018, which did not detect any radiological contamination exceeding the NRCs free release criteria. Additionally, since Centrus wished to retain the LCF license SNM-7003 for programmatic purposes only, the NRCs approval package of the FSSR included a license condition that No licensed material shall be received into the Lead Cascade without prior NRC approval.

The NRC staff has completed its review of Centrus October 17, 2019 request. The NRC staff has determined that the emergency plan requirement can be removed since, as discussed above, the LCF does not contain radiological contamination exceeding NRCs free release criteria and the LCF license prohibits Centrus from receiving any licensed material at the LCF without prior NRC approval.

Enclosure 2 transmitted herewith contains Security-Related Information. When separated from the sensitive conditions in Enclosure 2, this document and Enclosure 1 are decontrolled.
