RECEIPT OF DAVIS-BESSE REPLY TO NON-CITED VIOLATION IN NRC INSPECTION REPORT NO. 05000346/2004014 (NCV 2004014-02)

Dear Mr. Bezilla:

This will acknowledge receipt of your letter dated December 8, 2004, in response to our letter dated November 8, 2004, regarding corrective actions being taken with respect to a Non-Cited Violation (NCV) documented in Inspection Report 05000346/2004014 at the Davis-Besse Nuclear Power Station for inadequate corrective actions associated with repetitive operational performance issues. Due to the repetitive nature of the operational performance issues, we requested that you provide, within 30 days of the date of the November 8, 2004 letter, a written response detailing the corrective actions that had been implemented to avoid further similar violations and the basis for your belief that these corrective actions would be effective at preventing future operations department performance errors. In addition we requested your assessment of the impact that the deferral of corrective actions and effectiveness reviews has had on performance improvement in operations.

In your response to NCV 05000346/2004014-02, you accepted the NCV and described the corrective actions that had been implemented to avoid further similar violations. Additionally, your response included the basis for the belief that these corrective actions would be effective at preventing future operations department performance errors and an assessment of the impact that the deferral of corrective actions and effectiveness reviews has had on performance improvement in operations. You stated that the actions taken constituted one-time actions and are considered complete.

We have reviewed your corrective action and have no further questions at this time. These corrective actions will be examined during future inspections.
