Davis-Besse Nuclear Power Station Supplemental Information Regarding License Amendment Application to Revise Technical Specifications 3/4.8.1.1 and 3/4.8.1.2 (License Amendment Request (LAR) 01-0009; TAC No. MC4173)

Ladies and Gentlemen:

This letter provides supplemental information regarding LAR 01-0009.

By letter dated August 20, 2004 (Serial Number 2957), the FirstEnergy Nuclear Operating Company (FENOC) submitted a license amendment application for the Davis-Besse Nuclear Power Station (DBNPS). The proposed amendment would revise Technical Specification (TS) Surveillance Requirement (SR) 4.8.1.1.1 .b to be consistent with the DBNPS design basis requirements for offsite power sources. Additionally, TS 3/4.8.1.1 would be revised to delete SR 4.8.1.1.2.d.4, which requires verification that the Emergency Diesel Generator (EDG) auto-connected loads do not exceed the 2000-hour load limit. The proposed amendment would also revise TS 3/4.8.1.2, "A.C. Sources -

Shutdown," to add exceptions to the SR 4.8.1.2 Surveillance Requirements performed for Modes 5 and 6. By facsimile on November 4, 2004, the NRC requested additional information regarding the proposed amendment. FENOC submitted a response to this request on June 16, 2005 (Serial Number 3142).

As a result of discussions between FENOC and NRC staff on October 20, 2005, FENOC has decided to withdraw the portion of LAR 01-0009 that requested clarification of Surveillance Requirement 4.8.1.1.1.b.

Docket Number 50-346 License Number NPF-3 Serial Number 3204 Page 2 In addition, FENOC commits to relocate SR 4.8.1.1.2.d.4 to the Technical Requirements Manual (TRM), which is incorporated by reference in the USAR and therefore subject to the change control requirements of 10 CFR 50.59 as well as the update and reporting requirements of 10 CFR 50.71(e). This change will be made concurrent with or prior to implementation of the proposed amendment.

Other than the administrative description of the changes, the previously submitted evaluation for LAR 01-0009 is unaffected, including the technical analysis, no significant hazards consideration, and environmental consideration. includes a list of regulatory commitments made in this letter.
