Case: 09-2567 Document: 00319763781 Page: 1 Date Filed: 08/11/2009 UNITED STATES COURT OF APPEALS FOR THE THIRD CIRCUIT No. 09-2567 New Jersey Environmental Federation v. United States Nuclear Regulatory Commission To: Clerk

1) Motion by Petitioners for Extension of Time to File Brief and Appendix
2) Motion by Petitioners to Compel Respondent's to Provide a Complete Record on Review and For Other Appropriate Relief The foregoing motions are considered. The motion for extension of time is denied as presented. Petitioner's brief and appendix must be filed and served on or before September 30, 2009. It is noted that Petitioner is requesting an extension of time on behalf of Respondent and Intervenor. That request is denied as counsel lacks standing to make such request. Should counsel for Respondent and Intervenor need an extension of time to file their brief, counsel must file an appropriate motion. Action on the motion to compel is deferred pending the filing of a response to the motion.

For the Court,

/s/ Marcia M. Waldron Clerk Dated: August 11, 2009 tmk/cc: Richard Webster, Esq.

Robert M. Rader, I, Esq.

Arnold Fagg, Esq.
