If an applicant withdraws its application, then our review ends, and no further actions are taken by the NRC. If we determine that an application is incomplete, there are three options:

  • We may ask the applicant to supplement its application with the needed information. Our review gets placed on hold until we have the supplement.
  • We may ask the applicant or the applicant may choose to withdraw, revise, and resubmit its application. Our review ends until we have the revised application.
  • If the information holes are determined to be very minor or if we simply need clarification on certain points, we request additional information from the applicant via formal letter. In this case, we would continue reviewing other portions of the application while we wait for the additional information.

There are no penalties associated with re-filing nor are there additional time-consuming procedures associated with re-filing. The re-filed application is received without prejudice.

There are two primary resources that our staff uses to conduct its acceptance review of a license renewal application. During this review, the staff determines if the application contains sufficient information for the NRC to conducts its review. For the safety portion of the review, the staff uses NUREG-1800, and for the environmental portion of the review, the staff uses NUREG-1555, Supplement 1.

What is the NRCs process if a utiiltys application is incomplete or is withdrawn? Does the NRC allow the utility to refile at a later date? Are there penalties or time-consuming procedures involved if a utility refiles (for any reason)? Is the refile received without prejudice?
