ACCEPTANCE FOR REVIEW OF NUCLEAR ENERGY INSTITUTE (NEI)

TOPICAL REPORT 94-01, REVISION 2-A SUPPLEMENT 1, INDUSTRY GUIDELINE FOR IMPLEMENTING THE PERFORMANCE-BASED OPTION OF 10 CFR PART 50, APPENDIX J (TAC NO. ME2164)

Dear Mr. Riley:

By letter dated September 2, 2009, NEI submitted for U.S. Nuclear Regulatory Commission (NRC) staff review Topical Report (TR) 94-01, Revision 2-A Supplement 1, Industry Guideline For Implementing The Performance-Based Option Of 10 CFR Part 50, Appendix J. The NRC staff has performed an acceptance review of the TR 94-01, Revision 2-A Supplement 1, and found that the material presented provides the technical information in sufficient detail to enable the staff to complete a detailed technical review. The NRC staff expects to issue its request for additional information by November 30, 2009, and issue its draft safety evaluation by March 12, 2010. The NRC staff estimates that the review will require approximately 100 staff hours including project management time. The review schedule milestones were discussed and agreed upon in an e-mail between Ms. Tanya Mensah and Ms. Julie Keys, Senior Project Manager, on October 29, 2009.

In accordance with the letter dated August 6, 2009 (Agencywide Documents Access and Management System Accession No. ML093060238), the Office of the Chief Financial Officer has waived the Section 170.21 of Title 10 of the Code of Federal Regulations fees associated with this TR review.
