Tom, Consistent with our discussion today, the NRC staff has considered the feedback provided by FENOC regarding RAI#2. To that end, the NRC is revising the RAI as follows [revisions bolded]:
2. Provide a schedule with the major project activities (e.g., milestones, status, completion dates) for the develop and submission of the LAR for the transition of the fire protection program to National Fire Protection Association Standard NFPA 805, "Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants," 2001 Edition. This schedule should include any planned supplements to the LAR, internal events, and fire probabilistic risk analyses to incorporate the risk significant improvements planned (Functional and Operational) for NFPA 805. This new schedule should be of sufficient detail to determine that the licensee will be able to submit by December 31, 2015 sufficient technical information, both in scope and depth, for the NRC staff to complete the detailed technical review. Additionally, the schedule should include a description of the remaining work to be performed for those tasks and milestones that are not completed with justification of any milestone completion dates that do not support submittal by December 31, 2015.

The NRC staff is requesting a response by Friday, May 30, 2014. Should FENOC not be able to support this date, please contact me as soon as possible. The NRC staff considers that your timely response to this request for additional information will help ensure sufficient time is available for staff review and contribute toward a timely determination regarding continuation of enforcement discretion.

Per my discussion with Tom on yesterday, please find the attached request for additional information concerning FirstEnergy Nuclear Operating Companys (FENOCs) April 1, 2014 2014 (Agencywide Documents and Management System (ADAMS) Accession No. ML14091A453) submittal to the NRC requesting a continuation of enforcement discretion concerning fire protection issues for Davis-Besse Nuclear Power Station, Unit No. 1. The NRC staff is reviewing your submittal and has determined that additional information is required to complete the review. The specific information requested is addressed in the attachment to this e-mail.

The NRC staff is requesting a response by Friday, May 30, 2014. Should FENOC not be able to support this date, please contact me as soon as possible.
