By application dated September 20, 2021 (ADAMS Accession No. ML21263A193), Energy Harbor Nuclear Corp. (the licensee) submitted four requests (RP-1, RP-2, RP-3, and RP-4) for relief from certain requirements of Title 10 of the Code of Federal Regulations (10 CFR) Section 50.55a, Codes and standards, at Davis-Besse Nuclear Power Station, Unit No. 1. Requests RP-1 and RP-2 propose the use of plant process computer points as digital instrumentation for inservice testing of certain pumps. Request RP-3 proposes to perform periodic functional testing and flow rate tests each cycle in lieu of vibration monitoring on certain inaccessible pumps.

Request RP-4 proposes to perform the comprehensive test of high pressure injection pumps each refueling outage in lieu of biennially and reclassify the pumps from Group B to Group A in order to include vibration test requirements during the quarterly pump tests.

The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of these requests. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it provides technical information in sufficient detail to enable the staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the requests in terms of regulatory requirements and the protection of public health and safety and the environment.

Given the lesser scope and depth of the acceptance review, as compared to the detailed technical review, there may be instances in which issues that impact the staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the staffs detailed technical review by separate correspondence.

Based on the information provided in your submittal, the NRC staff estimates that each request will take approximately 100 hours0.00116 days <br />0.0278 hours <br />1.653439e-4 weeks <br />3.805e-5 months <br /> to review. The staff expects to complete its review of these requests by September 21, 2022. These estimates are based on the staffs initial review of the application and they could change due to several factors, including requests for additional information. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes to the forecasted hours, I will inform you of the reason for the change and provide the new estimates.
