UNIVERSITY OF TEXAS AT AUSTIN - ACCEPTANCE OF REQUESTED LICENSING ACTION RE: LICENSE AMENDMENT REQUEST TO MODIFY THE SPECIAL NUCLEAR MATERIAL POSSESSION LIMITS FOR THE UNIVERSITY OF TEXAS AT AUSTIN TRIGA NUCLEAR RESEARCH REACTOR (EPID NO. L-2019-LLA-0033)
Dear Dr. Charlton:
By letter dated February 18, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19053A521), as supplemented by letters dated February 27, 2019, March 11, 2019, and March 15, 2019 (ADAMS Accession Nos. ML19067A245 (redacted version), ML19074A108, and ML19079A157, respectively), the University of Texas at Austin (UTA) submitted a license amendment request (LAR) to Facility Operating License No. R-129 for the UTA TRIGA (Training, Research, Isotopes, General Atomics) nuclear research reactor to amend its license. The LAR indicates that the proposed changes would increase the possession limit for uranium-235 foils used in reactor experiments and transfer the possession of plutonium-beryllium sealed neutron sources from the licensees Title 10 of the Code of Federal Regulations (10 CFR) Part 70, Domestic Licensing of Special Nuclear Material, broad scope material license, No. SNM-180, to its 10 CFR Part 50, Domestic Licensing of Production and Utilization Facilities, Facility Operating License No. R-129, along with editorial changes and corrections. Consistent with Section 50.90, Application for amendment of license, construction permit, or early site permit, of 10 CFR, an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. The requirements in 10 CFR 50.34, Contents of applications; technical information, cover the technical information to be included in the application and stipulate that it address design and operating characteristics, unusual or novel design features, and principal safety considerations.
The U.S. Nuclear Regulatory Commission (NRC) staff performed an acceptance review of the LAR and concluded that it includes sufficient information for the NRC staff to begin its detailed technical review. Notwithstanding the acceptance review, the NRC staff may require additional information to complete the detailed technical review. If needed, the NRC staff will request this information by separate correspondence within approximately 60 days.
Based on the acceptance review, the NRC staff expects to complete its review and make a final determination on the LAR by November 18, 2019. This date could change due to several factors, including requests for additional information, unanticipated changes to the scope of the review, unsolicited supplements to the LAR, and others. If the forecasted date changes, the
