U.S. Nuclear Regulatory Commission Public Meeting Summary May 22, 2019 Title: Public Meeting to Discuss the Proposed Implementation Date of The Draft Final Non-Power Production or Utilization Facility License Renewal Rule Meeting Identifier: 20190414 Date of Meeting: Thursday, April 25, 2019 Location: NRC Headquarters, Rockville, MD Type of Meeting: Category 3 Purpose of the Meeting(s):
To provide an overview of the NRC staffs preliminary thoughts on the proposed implementation schedule of the final non-power production or utilization facility (NPUF) license renewal rule. In addition, the NRC staff described the groupings of NPUF licensees that will determine the due dates for submitting updated final safety analysis reports (FSARs) and subsequent FSAR updates to the NRC.
General Details:
The final rule would: (1) eliminate license terms for facilities (other than testing facilities) licensed under Title 10 of the Code of Federal Regulations (10 CFR) Section 50.21(a) or (c);
(2) define the license renewal process for NPUFs (including testing facilities) licensed under 10 CFR 50.22, Class 3 licenses; for commercial and industrial facilities, and testing facilities licensed under 10 CFR 50.21(c); (3) require all NPUF licensees to submit to the NRC an updated FSAR and subsequent FSAR updates at intervals not to exceed 5 years; and (4) provide an accident dose criterion of 0.01 sievert (1 rem) total effective dose equivalent for NPUFs other than testing facilities. The final rule also includes additional changes described in the draft Federal Register notice for the NPUF final rule, which can be found in Agencywide Documents Access and Management System (ADAMS) under Accession No. ML19008A094.
The meeting was attended by 19 people. An additional 21 individuals participated in the meeting through webinar and audio teleconferencing.
Summary of Presentations:
Robert H. Beall, NRC Division of Rulemaking, Office of Nuclear Material Safety and Safeguards, provided opening remarks. Mr. Beall discussed the history of the NPUF rulemaking and its current status. Mr. Beall also discussed the proposed implementation date for the final rule. Mr. Beall noted that the draft final rule implementation date is the same as that in the proposed rule and that the NRC factored in the time required for licensees to develop or revise procedures, or both, and to allow licensees to become familiar with the final rule.
After Mr. Bealls remarks, Duane Hardesty, NRC Division of Licensing Projects, Office of Nuclear Reactor Regulation, discussed the nine rulemaking objectives of the final rule and explained that no immediate implementation actions are required by licensees. After Mr. Hardestys remarks, Alexander Adams, NRC Division of Licensing Projects, Office of Nuclear Reactor Regulation, discussed the process the NRC will use to implement nonexpiring licenses and FSAR submittals. After Mr. Adams discussion, Howard Benowitz, NRC Office of the General Counsel, discussed the Nuclear Energy Innovation and Modernization Act and explained that a public meeting will take place to discuss relevant aspects of the new statute related to research reactor and testing facilities.
Public Participation Themes:
During the open discussion part of the meeting, participants raised 10 questions. Some questions addressed the reasoning behind the groupings of licensees for FSAR updates.
Other questions addressed the timing of subsequent FSAR updates.
Action Items/Next Steps:
The NRC staff will consider the feedback from the meeting and use it to inform the decision process on whether to further adjust the proposed implementation date in the final NPUF rule. At this time, the NRC staff is not planning to hold additional public meetings to discuss the implementation date of this final rule.
