H. B. ROBINSON STEAM ELECTRIC PLANT, UNIT NO. 2 - EXTENSION OF THE RESPONSE DEADLINE FOR REQUEST FOR ADDITIONAL INFORMATION REGARDING THE SUPPLEMENTAL RESPONSE TO GENERIC LETTER 2004-02, "POTENTIAL IMPACT OF DEBRIS BLOCKAGE ON EMERGENCY RECIRCULATION DURING DESIGN BASIS ACCIDENTS AT PRESSURIZED WATER REACTORS" (TAC NO. MC4709)

Dear Mr. Walt:

By letter dated October 17, 2008 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML082980355), Carolina Power & Light Company, now doing business as Progress Energy Carolinas, Inc. (PEC, the licensee), requested an extension for submitting answers to questions posed in a Request for Additional Information (RAI) dated July 25, 2008 (ADAMS Accession No. ML081900649).

The July 25, 2008, RAIs were in regard to a PEC letter dated March 7, 2008 (ADAMS Accession No. ML080730290), which submitted a supplemental response to Generic Letter (GL) 2004-02, "Potential Impact of Debris Blockage on Emergency Recirculation During Design Basis Accidents at Pressurized Water Reactors," for the H.B. Robinson Steam Electric Plant, Unit No. 2 (HBRSEP).

The U.S. Nuclear Regulatory Commission (NRC) staff initially requested that PEC respond to these RAIs within 90 days of the date of the original letter, which established a response deadline of October 23, 2008. However, the July 25, 2008, letter included the caveat that "if the licensee concludes that more than 90 days are required to respond to the RAIs, the licensee should request additional time, including a basis for why the extension is needed."

The licensee's October 17, 2008, letter stated that additional time is needed to adequately respond to the RAIs. The basis for this request is that HBRSEP is currently conducting Refueling Outage (RO)-25, which is challenging the resources needed to properly address the RAIs. An extension of 50 days was requested by the licensee to allow completion of preparation of the RAI responses after RO-25. This would result in a new RAI due date of December 12, 2008.

The NRC staff finds PEC's request for an extension to be reasonable based on the above considerations. We now request that you submit the responses to the subject RAIs by December 12, 2008. Please contact me at 301-415-3178 if you have any questions or concerns regarding this issue.
