ORDER (Granting Joint Motion to Hold Disclosures in Abeyance)

On January 28, 2010, this Licensing Board admitted a new contention based on information contained in the NRC Staff's Safety Evaluation Report.

1 On February 12, 2010, Applicant Northern States Power Company (NSPM) and Intervenor Prairie Island Indian Community (PIIC) filed a joint motion to hold document disclosure on this safety culture contention in abeyance while the parties "discuss possible settlement of the PIIC's concerns."

2 The movants propose to submit a progress report to the Board in one month. They state that "[i]n the event that NSPM and the PIIC are unable to reach an agreement, a subsequent conference with all parties and the Board would be helpful to establish the schedule and 1 Licensing Board Order (Narrowing and Admitting PIIC's Safety Culture Contention) (Jan. 28, 2010) (unpublished).

3 The Board hereby grants the parties' joint motion. The Board also directs the parties to submit a report no later than March 19, 2010, updating the Board on the progress of settlement discussions. If the parties prove unable to reach an agreement, the Board will provide further direction regarding document disclosure and the creation of a hearing schedule.
