(formerly Nuclear Management Company, LLC) ASLBP No. 08-871-01-LR (Prairie Island Nuclear Generating Plant, Units 1 and 2) August 20, 2010 ORDER (Clarifying Amended Scheduling Order)
On August 18, 2010, the NRC Staff filed a letter with the Board1 seeking clarification of the hearing schedule in this docket. The appendix to the Boards April 20, 2010 Amended Scheduling Order2 indicates that motions for cross-examination are due September 7, 2010.
Footnote 3 of that Order states: These motions are filed in camera, and therefore no answers can be filed. The NRC Staff indicates that this footnote could be read to mean that both the motion for cross-examination and the cross-examination plan, which must accompany the motion, are filed in camera when in fact, in accordance with 10 C.F.R. § 2.1204(b)(2), only the cross-examination plan may be submitted in camera.
The NRC Staff is correct, and in response to its August 18, 2010 letter to the Board, we clarify our amended scheduling order as follows. Only cross-examination plans, and not their 1

accompanying motions for cross-examination, are to be filed in camera. Motions for cross-examination are due by September 7, 2010, and any answers to such motions are due by September 17, 2010.
