(formerly Nuclear Management Company, LLC) ASLBP No. 08-871-01-LR-BD01 (Prairie Island Nuclear Generating Plant, Units 1 and 2) February 27, 2009 ORDER (Granting Request for Extension of Time)
On February 27, 2009, the Prairie Island Indian Community (Community) filed an unopposed motion requesting a ten-day extension of time for providing the Initial Disclosures required by 10 C.F.R. § 2.336(a) and for filing a proposed protective order and nondisclosure agreement. The Community requests that the date be extended from February 27, 2009 to March 9, 2009 due to unforeseen circumstances. The Community has filed a declaration stating that its counsel has been indisposed and unavailable for six of the last eight days due to health issues. The Communitys motion further states that NRC Staff counsel agrees and consents to the Communitys motion, but will timely submit the hearing file required by 10 C.F.R. § 2.1203.
The motion also indicates that Northern States Power Company agrees and consents to the motion, provided that the extension also applies to Applicants disclosures and the potential filing of a proposed protective order and nondisclosure agreement.
For good cause shown, the Communitys unopposed motion requesting a ten-day extension of time for providing the Initial Disclosures required by 10 C.F.R. § 2.336(a) and for
filing a proposed protective order and nondisclosure agreement is GRANTED. The previously established deadline is extended from February 27, 2009 to March 9, 2009.
It is so ORDERED.
