MEMORANDUM (Notice pursuant to 10 C.F.R. § 2.309(i))
Pending before the Board is a Notice of Intent to Participate and Petition to Intervene (Petition) filed by the Prairie Island Indian Community (Petitioner) dated August 18, 2008, challenging the License Renewal Application submitted by Nuclear Management Company, LLC, now Northern States Power Co. (Applicant or Licensee) to the Nuclear Regulatory Commission (NRC) on April 11, 2008. On September 12, 2008, the Licensee and the NRC Staff filed oppositions to the Petition. Based on the September 19, 2008 filing of the Petitioners reply pleading, the Licensing Boards decision granting or denying the Petitioners request would be due on or before Wednesday, November 5, 2008. See 10 C.F.R. § 2.309(i).
Due to various factors, including a motion to strike, answers to that motion and an oral argument on standing and contention admissibility held in Hastings, MN on October 29, 2008,
the Board hereby provides notice pursuant to 10 C.F.R. § 2.309(i) that it currently anticipates issuing a decision regarding the Petitioners hearing request no later than December 5, 2008.
